Terms

In this document 'users', 'you' and 'your' mean the person accessing the App. 'Honesty Box', 'us' and 'we' mean Honesty Box Payments Ltd. 'Box owner' and 'owner' refers to those users who set up one or more boxes in the App.

By registering or using the App you agree to be bound by these terms and conditions. These terms form a legally binding contract between you and us.

Key definitions

The App - This website, hosted at www.honestybox.org and honestybox.org.

User - An individual using the app.

Location - Any venue, car park, site, nature reserve or other location registered to receive payments through the App.

What the terms cover

These terms and conditions apply to the use of, and access to, the App. Please read these terms carefully before using the App.

The terms:
  • Identify who we are and what happens to payments;
  • Explain the relationship between us and users of the App.

Who we are

We are Honesty Box Payments Ltd, a company registered in England and Wales, trading as Honesty Box. Our company registration number is 13095930 and our registered address is at 2 Bovet Street, Wellington, TA21 8JL.

Description

What we do

We provide an app/website to enable users to pay directly to box owners. All payments are voluntary, and anonymous to the beneficiaries. Box owners can use the App to inform users about the location they are visiting and to advertise their intended use for collected funds.

What we do not do

We do not issue parking tickets or enforce car park charges. We do not personally provide funds to community projects; all funding is via payments made through the App by users. We do not approve or verify fundraising aims, nor do we seek to verify or control how money is spent by the box owners.

Your Data

Our privacy policy explains how we collect, store, use and share your data.

Access to service

You are responsible for providing and paying for a secure internet or wireless access, and for ensuring that your device meets all the necessary technical specifications to enable your access to, and use of, the App. The App requires an internet data or wifi connection to function.

Accounts and Registration

Registering for an account is optional. For registered accounts, details of your recent transaction history and previously visited areas can be found in your account profile.

If you fail to provide accurate information when registering then we will be unable to contact you to confirm payments made. If this is the case, then please contact us immediately to correct the information we hold about you.

Some email providers may direct emails from us to a ‘junk’ or ‘promotions’ folder which may not be your regular inbox. Please check all folders carefully, we cannot be held responsible if you fail to receive communications in these circumstances.

Password security

Passwords should only be known to the user. We are not responsible for any action taken by any third party to whom you have disclosed your password. If you believe a third party has become aware of your password, and is using your account without your explicit authorization, please reset your password immediately, or notify us and we will close your account at our discretion.

Account closure

We may suspend or close your account at any time if you are in breach of any of these terms. We may also suspend or close your account if we deem that you have done anything to put our reputation at risk.

If you do not comply with your responsibilities as set out in these terms, or abuse or manipulate our services, we will immediately terminate or suspend your account or access to the App. If we choose to suspend or terminate an account we will inform you by email.

Reasons for termination may include:
  • Reports of unauthorised or unusual credit card use associated with the personal account including, but not limited to, notice by the card issuing bank. This includes notices made by you to your credit card company that a transaction was unauthorised or your account compromised, and is done in order to protect you from further unauthorised use of your card.
  • The cardholder name on the payment card associated with your account does not match the name registered for the account.
  • We believe that your account or activities pose a significant credit or fraud risk to us.

Parking rule compliance

You cannot use the App to pay for parking. If you park in a car park with compulsory charges, then you should make the specified payment as directed. We are not responsible for any parking charges or penalties for non-payment that may arise. Any payments made via the App are a voluntary payment to box owners, and are separate and distinct from any other locally mandated payments or charges.

Making Payments

The App uses a third party payment provider, Stripe Payments Europe Limited (Stripe) to enable you to make online payments. Separate terms and conditions will apply to the provision of payment services provided to you. Any personal information you provide to Stripe will be processed in accordance with their privacy policy and not ours.

Card payments are securely processed by Stripe and passed to box owners. We do not receive, process, or hold your card details at any point during the transaction. We receive a small commission for each payment made through the App, which is transferred to us by Stripe upon successful completion of a transaction.

Refunds

If you made a payment in error, or if you have changed your mind and would like to cancel a payment, you can do so if you notify us within 14 days. Please note that payments can only be refunded to the original payment method, and will be subject to a cancellation fee to cover payment processing costs.

Receiving Payments

Box owners must register with Stripe to receive payments, and in doing so comply with their terms and conditions.

Payments for boxes will only be accepted via the App once a Stripe account is set up by the box owner. If at any time, a box owner's Stripe account becomes inactive, the collection of payments for all of their boxes will be suspended until the account is reactivated.

Monies from successful payments are tranferred into the box owners Stripe account, and our commission is deducted. It is the box owners responsibility to provide accurate banking and identification information to Stripe to enable timely payouts of received funds. We are not responsible for lost funds or delays to withdrawals.

Disclaimer

We do not moderate or verify the accuracy of information added by box owners. If you become aware of inappropriate or illegal text or images, you can report them to us by emailing us at info@honestybox.org. All information added by box owners is the responsiblity of the person or entity that provides it to the App.

We do not own or operate any parking facilities or provide or manage access to locations. To the fullest extent permissible by law we are not responsible for death, injury or property damage of any nature whatsoever, resulting from your access to and use of parking areas and locations.

In whatever role you access the App, we are not responsible for any interruption or cessation of transmission to or from the App; any bugs, viruses, or similar, which may be transmitted to or through the App by any third party, or for any loss or damage of any kind incurred as a result of your use of the App however caused.

Changes

We may change these user terms, our privacy statement, our fees, and the App itself from time to time. If we change these user terms they will be updated on the website and in the App, and all registered users will be notified by email. If you continue to use the App or the Service after the update, that will constitute your acceptance of the latest version of these user terms.

Cancellation

We may cease to provide this service to you at any point. As soon as is reasonably practicable we will notify you of our decision to stop providing our services. No compensation or other costs are payable if we cease to provide this service for any reason.

Warranty

We provide the App with reasonable care and skill.

We do not warrant that the App will meet your specific requirements, that it will be uninterrupted, timely, secure, error free, accurate, or reliable, or that any errors in the App will be corrected.

Intellectual property

We own, or otherwise hold the right to use and make available, all intellectual property rights in respect of: the App (including text, graphics, software, images, sound), and our logo.
